NEW CONSTRUCTION

BUYER'S AGENCY AGREEMENT

In Indiana, a Buyer's Agency Agreement is a legally binding contract between a real estate brokerage and a homebuyer outlining the terms of the working relationship to buy real estate. Since July 1, 2024, this agreement has become mandatory for real estate brokers to represent buyer clients. 

Key aspects of the Buyer's Agency Agreement in Indiana:

Written and Signed:

  • The agreement must be in writing, either on paper or electronically, and signed by the broker and the buyer. 

Clear Terms:

  • The agreement outlines the responsibilities of both parties, including the broker's duties to represent the buyer's best interests and the buyer's commitment to working with the broker. 

Expiration Date:

  • The agreement must include a definitive expiration date. 

Copy to Buyer:

  • The broker must provide the buyer with a copy of the agreement within three business days of signing. 

Compensation:

  • The agreement should clarify how the buyer's agent will be compensated, though in some cases, the seller may pay the commission. 

Benefits for Buyers:

  • The agreement provides clarity, legal protection, and access to the broker's expertise and network. 

Protects Brokers:

  • The agreement clarifies the relationship between the broker and the buyer, helping to avoid misunderstandings and potential legal issues. 

Exclusive vs. Non-Exclusive:

  • Buyers can choose between an exclusive agreement (where they only work with one broker) or a non-exclusive agreement (where they can work with multiple brokers).
